These Terms & Conditions ("Terms") govern your access to and use of the InspectoMX platform at inspectomx.com and its applications (the "Service"), operated by InspectoMX ("we", "us"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

InspectoMX is a software platform that lets independent property inspectors conduct inspections and produce professional bilingual reports, including offline in the field. The Service is licensed, not sold. We may add, change, or discontinue features.

2. Accounts

You must provide accurate information and are responsible for safeguarding your credentials and for all activity under your account. You must be of legal age and authorized to enter into these Terms. You are responsible for the inspections, content, and reports you create.

3. Plans, billing, and trial

Subscriptions (Starter, Pro): billed in advance on a recurring monthly basis until cancelled.
Single Report: a one-time purchase granting one report credit.
Free trial: a 7-day trial requires a valid payment method and automatically converts to a paid Starter subscription at the end of the trial unless you cancel before it ends.
Prices and taxes: prices are stated in Mexican Pesos (MXN) and are exclusive of any applicable taxes unless stated otherwise. Payments are processed by Stripe.
Cancellation: you may cancel a subscription at any time; cancellation stops future renewals and access continues until the end of the current paid period.

4. No refunds. All sales are final. Subscription fees, single-report purchases, and any amounts charged when a free trial converts are non-refundable, in whole or in part, including for unused time or unused report credits. Manage or cancel your plan before your next billing date to avoid further charges.

5. Acceptable use

You agree not to misuse the Service, including: reselling or sublicensing the Service except as expressly permitted; reverse-engineering or copying the platform; uploading unlawful content or content that infringes others' rights; attempting to gain unauthorized access; or using the Service to produce reports you are not professionally qualified or authorized to issue.

6. Your clients and their data

When you use InspectoMX to inspect properties and prepare reports for your clients, you are the party responsible for your clients' personal data and for obtaining any necessary consents; InspectoMX acts only as a processor on your behalf. You are responsible for complying with applicable law, including the LFPDPPP, and our Privacy Notice.

7. Inspection reports are professional opinion — not a warranty. InspectoMX provides software tools only; it does not perform inspections, verify findings, or guarantee the condition of any property. A report generated with the Service reflects the issuing inspector's professional opinion as of the inspection date and is not a warranty, guarantee, or insurance of any kind. InspectoMX is not a party to, and assumes no liability for, any inspection, report, or the relationship between an inspector and their client.

8. Intellectual property

The Service, including its software, design, and content, is owned by InspectoMX and protected by law. We grant you a limited, non-exclusive, non-transferable license to use the Service per these Terms. You retain ownership of the inspection content and reports you create; you grant us the limited rights needed to host and provide the Service to you.

9. Disclaimers and limitation of liability

The Service is provided "as is" and "as available", without warranties of any kind to the maximum extent permitted by law. To the maximum extent permitted by law, InspectoMX's total liability for any claim arising out of or relating to the Service is limited to the amount you paid us for the Service in the three (3) months preceding the claim, and we are not liable for indirect, incidental, special, or consequential damages.

10. Indemnification

You agree to indemnify and hold InspectoMX harmless from claims arising out of your use of the Service, the reports and inspections you produce, or your breach of these Terms or of applicable law.

11. Termination

You may stop using the Service at any time. We may suspend or terminate access for breach of these Terms or where required by law. Provisions that by their nature should survive termination (e.g., payment obligations, disclaimers, limitation of liability) survive.

12. Governing law

These Terms are governed by the laws of Mexico. For any dispute, you and InspectoMX submit to the competent courts of Puerto Vallarta, Jalisco, Mexico, waiving any other jurisdiction that may correspond.

13. Changes and contact

We may update these Terms; the current version is always at this page with the "Last updated" date above, and continued use after changes constitutes acceptance. Questions: [email protected].

Spanish-language version available via the ES toggle above. In case of any discrepancy, the Spanish version prevails for purposes of Mexican law.

Estos Términos y Condiciones ("Términos") regulan su acceso y uso de la plataforma InspectoMX en inspectomx.com y sus aplicaciones (el "Servicio"), operada por InspectoMX ("nosotros"). Al crear una cuenta o usar el Servicio, usted acepta estos Términos. Si no está de acuerdo, no utilice el Servicio.

1. El Servicio

InspectoMX es una plataforma de software que permite a inspectores de inmuebles independientes realizar inspecciones y elaborar reportes profesionales bilingües, incluso sin conexión en campo. El Servicio se licencia, no se vende. Podremos agregar, modificar o descontinuar funciones.

2. Cuentas

Usted debe proporcionar información veraz y es responsable de resguardar sus credenciales y de toda actividad realizada en su cuenta. Debe ser mayor de edad y estar facultado para aceptar estos Términos. Usted es responsable de las inspecciones, el contenido y los reportes que cree.

3. Planes, facturación y prueba

Suscripciones (Starter, Pro): se cobran por adelantado de forma recurrente mensual hasta su cancelación.
Reporte Individual: compra única que otorga un crédito de reporte.
Prueba gratuita: la prueba de 7 días requiere un método de pago válido y se convierte automáticamente en una suscripción Starter de paga al finalizar, salvo que cancele antes de que termine.
Precios e impuestos: los precios se expresan en Pesos Mexicanos (MXN) y no incluyen impuestos aplicables salvo que se indique. Los pagos los procesa Stripe.
Cancelación: puede cancelar una suscripción en cualquier momento; la cancelación detiene futuras renovaciones y el acceso continúa hasta el fin del periodo pagado vigente.

4. Sin reembolsos. Todas las ventas son finales. Las cuotas de suscripción, las compras de Reporte Individual y cualquier monto cobrado al convertirse una prueba gratuita no son reembolsables, total ni parcialmente, incluido el tiempo no utilizado o los créditos de reporte no usados. Administre o cancele su plan antes de su próxima fecha de cobro para evitar cargos adicionales.

5. Uso aceptable

Usted se obliga a no hacer mal uso del Servicio, incluyendo: revender o sublicenciar el Servicio salvo autorización expresa; realizar ingeniería inversa o copiar la plataforma; cargar contenido ilícito o que infrinja derechos de terceros; intentar accesos no autorizados; o usar el Servicio para emitir reportes para los que no esté profesionalmente calificado o autorizado.

6. Sus clientes y sus datos

Cuando utiliza InspectoMX para inspeccionar inmuebles y preparar reportes para sus clientes, usted es el responsable de los datos personales de sus clientes y de obtener los consentimientos necesarios; InspectoMX actúa únicamente como encargado por su cuenta. Usted es responsable de cumplir la ley aplicable, incluida la LFPDPPP, y nuestro Aviso de Privacidad.

7. Los reportes de inspección son una opinión profesional — no una garantía. InspectoMX provee únicamente herramientas de software; no realiza inspecciones, no verifica hallazgos ni garantiza la condición de inmueble alguno. Un reporte generado con el Servicio refleja la opinión profesional del inspector emisor a la fecha de la inspección y no constituye garantía ni seguro de ningún tipo. InspectoMX no es parte de, ni asume responsabilidad por, ninguna inspección, reporte, o la relación entre un inspector y su cliente.

8. Propiedad intelectual

El Servicio, incluido su software, diseño y contenido, es propiedad de InspectoMX y está protegido por la ley. Le otorgamos una licencia limitada, no exclusiva e intransferible para usar el Servicio conforme a estos Términos. Usted conserva la titularidad del contenido de inspección y reportes que cree; nos otorga los derechos limitados necesarios para alojar y prestarle el Servicio.

9. Exención y limitación de responsabilidad

El Servicio se proporciona "tal cual" y "según disponibilidad", sin garantías de ningún tipo en la máxima medida permitida por la ley. En la máxima medida permitida por la ley, la responsabilidad total de InspectoMX por cualquier reclamación derivada o relacionada con el Servicio se limita al monto que usted nos pagó por el Servicio en los tres (3) meses previos a la reclamación, y no respondemos por daños indirectos, incidentales, especiales o consecuenciales.

10. Indemnización

Usted se obliga a indemnizar y sacar en paz y a salvo a InspectoMX de reclamaciones derivadas de su uso del Servicio, de los reportes e inspecciones que produzca, o de su incumplimiento de estos Términos o de la ley aplicable.

11. Terminación

Usted puede dejar de usar el Servicio en cualquier momento. Nosotros podemos suspender o terminar el acceso por incumplimiento de estos Términos o cuando la ley lo requiera. Las disposiciones que por su naturaleza deban subsistir (p. ej., obligaciones de pago, exenciones y límites de responsabilidad) sobrevivirán.

12. Legislación aplicable

Estos Términos se rigen por las leyes de México. Para cualquier controversia, usted e InspectoMX se someten a los tribunales competentes de Puerto Vallarta, Jalisco, México, renunciando a cualquier otro fuero que pudiera corresponder.

13. Cambios y contacto

Podremos actualizar estos Términos; la versión vigente estará siempre en esta página con la fecha de "Última actualización", y el uso continuado tras los cambios constituye su aceptación. Dudas: [email protected].
